California's builders remedy is the 'stick' for local housing strategies

California has a law that means that if a local government does not have a state-approved housing plan, then development applications that provide 20% affordable or 100% moderate-income housing must be approved. Even if they are in conflict with zoning and development controls.


This is proving controversial in California. The example of Palo Alto is testament, which has twice had their proposed housing element rejected by the Californian Department of Housing and Community Development.


The requirements set by the Department are detailed and until the city can meet these requirements, the builders remedy remains in place.
